IMMI SCHOOL – Terms of ServiceEffective Date: 28/07/2025
These Terms of Service ("Agreement") form a legally binding contract between you ("you", "your", "client") and IMMI SCHOOL Pty Ltd (“IMMI SCHOOL”, "we", "us", "our") regarding your access to and use of our online courses, pre-recorded document preparation guides (the "DIY kits"), and related educational materials (“Services”).
By engaging our Services or making a payment, you confirm your acceptance of these Terms. If you do not agree with these Terms, do not use our Services.
1. Nature of Services, Educational Purpose & DisclaimerIMMI SCHOOL provides pre-recorded educational materials ("courses," "lectures," "DIY kits") designed to help you understand the steps commonly involved in preparing various types of documents (e.g., for visa, employment, education, or similar applications).
2. Educational Use Only:All materials are for your personal education, self-help, and private use. They do not constitute, nor are to be relied upon as, legal, migration, professional, or personalized advice.
3. No Client Relationship:Use of our Services does
not create a client-advisor, client-agent, or client-lawyer relationship. For advice tailored to your circumstances, you must consult a qualified, registered professional (e.g., migration agent, lawyer).
4. Currency of Information:Materials are current as at the date of production; laws, policies, and requirements may change. You must independently verify that instructions remain applicable prior to taking action.
5. Enrolment, Payment & Access- Once payment is received in full, we grant you non-transferable, non-exclusive access to the purchased materials for your personal use.
- Content is delivered electronically (e.g., video/audio/viewable/downloadable files), accessible through our designated platform.
- We reserve the right to update, modify, or withdraw materials as needed; we will endeavor (where feasible and lawful) to maintain access to materials purchased, but cannot guarantee perpetual or universal access.
6. Refunds, Cancellations, and Consumer GuaranteesAll sales are final once access is granted, except as required by the Australian Consumer Law ("ACL"; see below).
- If materials are defective, not as described, or otherwise breach your ACL rights, you may be entitled to a remedy - contact us within 24 hours if you believe this applies.
- No refunds, cancellations, or credits will be offered for change of mind, accidental purchase, or where access to content has been granted and 24 hours has passed since the purchase.
7. Intellectual Property and Use- All content (including courses, guides, format documents, and communications) is protected by copyright (Copyright Act 1968 (Cth)) and other intellectual property laws in Australia.
- You may view, download, and print materials for your sole personal use only.
You must NOT:- Reproduce, share, distribute, transmit, adapt, upload, or make available our materials (including templates, guides) in any public or commercial forum, offline or online;
- Use the materials for any paid service to others;
- Remove or obscure any copyright or proprietary notices.
- Assignments or comments you post as part of your learning may be used by IMMI SCHOOL for instructional or course improvement purposes, in compliance with our Privacy Policy.
8. Limitation of Liability- IMMI SCHOOL takes reasonable care to ensure accuracy, but does not warrant completeness, continued accuracy, or suitability of materials for your unique situation. No guarantee is given that using our guides will result in approval by any authority or body.
- To the extent permitted by law, our maximum liability is limited to the amount paid for the course or service.
We are not responsible for:- Any loss, error, delay, omission, or consequence arising from your reliance on or use of the materials;
- Any changes in law/policy affecting information provided.
9. Compliance & User Responsibilities- You must ensure all documents you prepare or submit via government or other channels comply with current law, policy, and the requirements of the relevant authority.
- You are solely responsible for verifying your eligibility prior to submission and for the outcomes of your applications.
- For complex or high-stakes applications (e.g. visas, legal, migration, professional registration), IMMI SCHOOL recommends obtaining advice from a registered professional or authority.
10. Privacy- We collect and manage your personal information strictly in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).
- Your personal data is used for processing enrolments, delivering services, providing support, and/or as required by law.
- You have the right to access and request correction of your personal information.
11. JurisdictionGoverning Law:
This Agreement is governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
Dispute Resolution Procedure:
a.
Internal Resolution: In the event of a dispute arising out of or in connection with this Agreement, you agree to first notify IMMI SCHOOL in writing, providing full details of the issue. Both parties must make genuine efforts to resolve the dispute through direct negotiation within 30 days of written notification.
b.
Mediation: If the dispute is not resolved through direct negotiation, either party may request that the dispute be referred to mediation, to be conducted in Queensland in accordance with the rules of the Australian Disputes Centre or a similar body agreed by both parties. Parties must attend and participate in good faith in the mediation process. Costs of mediation will be shared equally unless otherwise agreed.
c.
Court Proceedings: Only if the dispute remains unresolved 30 days after conclusion of mediation, may either party commence proceedings in a court of competent jurisdiction in Queensland, Australia.
12. AmendmentsWe may update these Terms as required by law or to reflect changes in services. The most current version will be published on our website and will apply from the date of publication.
